The opportunity of citizens to get acquainted with the court system is limited

01/06/2010

Russian courts will publish on the Internet information about court proceedings and decisions in the truncated form. Restrictions on publication of information on cases and texts of judicial decisions will operate from 1 July this year.

Information about cases involving state security, on matters relating to family law relationships can not be placed in the open access. You can not post information on cases involving juveniles, «crimes against sexual inviolability and sexual freedom of the individual», the forced hospitalization of people in psychiatric stantsionary etc. In addition, in order not to violate the law on personal data, the judges will have to abandon the practice of publishing the names involved in the affairs of individuals. It will be forbidden to post information on cases involving juveniles, «crimes against sexual inviolability and sexual freedom of the individual», the forced hospitalization of people in psychiatric stantsionary etc. In order not to violate the law on personal data, the judges will have to abandon the practice of publishing the names involved in the affairs of individuals.

Other personal data should be removed too: address the participants involved, date of birth,  information about vehicles, details of identity documents, and so on. It will be needed to hide sensitive data: information related to personal and professional life, except for information to be disseminated in the media in the cases stipulated by federal laws.

According to new rule courts have the right to conceal information about pending cases, including information about working with them judges — to avoid pressure on the actors. Full text of judicial decisions can be replaced by summaries of decisions.

Russiaexperts believe that such a reduction would lead to that this information courts’ base will   be ceased to be useful.
